The Wrong Approach To The War On Terrorism

Today, 6/29/06, The US Supreme Court issued a ruling in a suit brought by Osama bin Laden's driver and body guard, Salin Ahmed Hamdan (Hamdan v. Rumsfeld), that stated that the Bush Administration can not try certain terrorists being held at Guantanamo Bay by military tribunal. They must be tried either in federal court or by military courts martial. The administration did not have the authority to make that decision according to the Court. It had to be made by Congress. The Court basically rewrote legislation that clearly authorized military tribunals for enemy combatants, not in uniform, captured in battle. The Court also had the audacity to rewrite the Geneva Convention, which is well beyond their juridiction. This is an outrage! Other examples of impediments to the war have been the "leaking" of classified information to the media about CIA rendition programs, NSA data mining programs, and the "leaking" of highly classified information to the New York Times about our government tracking the enemy's financial transactions. As a result of these developments, I believe that our national security has been dangerously compromised. Shame on the Supreme Court for this decision. Shame on the New York Times, and shame on the enemies of America.

Traitors are working in our government intelligence agencies leaking top secret information to an anti-American, anti-Bush media in order to cause the United States of America to fail in the war against Western Civilization. They are moving us one step further toward forcing the US into a one world government "managed" by United Nations Socialist Elites. In 1950, banker Paul Warburg testified before Congress: "There will be a one world government. The question is, will America become part of it by cooperation or by coercion?" This is where this is all leading. Causing the US to fail in the war on terror, is just part of the master plan to force us into a Socialist and eventually a Communist one world government controlled by the UN.

Now for the current matter at hand. There have been many blunders over the years fighting terrorism. Let's take a look at the biggest mistake of them all. After 9/11, President Bush went to Congress in order to get authorization to use force. His big mistake was, he did not ask Congress for a formal declaration of war. Ever since World War II, which was the last time that Congress issued a formal declaration of war, there have been numerous "police actions," so in some ways, I guess you could say that the Supreme Court was sort of right. Without a formal declaration of war, there is too much gray area.

According to Article 1, Section 8 of the US Constitution, only Congress has the right to "declare war [and] grant letters of marque and reprisal." Korea, Vietnam, Panama, Granada, Gulf War I, Haiti, Somalia, Kosovo, and the current war have been undeclared wars. Every president since Harry Truman has justified their decisions to send our troops into combat by claiming that according to Article 2, Section 2 of the US Constitution that they have the authority to do that as Commander In Chief without congressional authorization despite what the Constitution says about Congress having the sole right to "declare war." It's a gray area. Congress tried to settle the argument in 1973 with the War Powers Resolution, but that has been meaningless. Presidents have claimed authority to act outside of Congress by claiming that sending in our troops are not acts of war, but missions of international security. Consequently, we are facing a huge can of worms.

The recent Supreme Court decision states that the President can get congressional authorization to conduct military tribunals. President Bush needs to do that as soon as possible. This decision, while being hailed as a victory by the liberals, could actually blow up in their face. There is an election coming up in November. The urban and suburban Marxist intellectual elite types that are in love with Socialism, are not the majority of Americans. While most Americans are tired of this war, they aren't going to look favorably upon any candidate, incumbent or challenger, who would vote to give these enemies of America access to a court system where they could be acquitted by a legal technicality. Nor will they look favorably upon Congress if debate and vote on this issue is tabled until after the November elections. Along with this, the President needs to take it one step further: War against America has been declared from thousands of mosques throughout the world, including here in the United States. Acts of war against the United States' interests have been going on for years, with 9/11 being the final straw. We've been mamby pambying this war for the past five years. It's time to take off the gloves and show that we mean business. Yes, there will be many casualties, but the end result will be less casualties in the long run. It was the same thing with Japan during WW II. By dropping two atomic weapons we killed about half a million people. However, by doing so, we prevented an invasion of the Japanese mainland, which would have dragged the war on for at least another two years, and would have caused losses of life in the millions. Japan knew this, and waved the white flag.

The President needs to ask Congress for a formal declaration of war against Islamic terrorism and the nations that harbor them. If granted, and remember, this is an election year, Bush can prosecute this war to the fullest extent of the law both in the theaters of combat, and here against the Fifth Column who's treason is undermining the war effort. Going after the so called "enemy within," is perfectly legal during a time of declared war.

After Congress gives the Declaration, we must move to immediately seal our borders. We should have done this right after 9/11 anyway. Then we enforce the Alien Registration Act of 1940, or as it is called, the Smith Act. This law is still on the books. This act makes it illegal for any group to advocate the overthrow or destruction of our government. Violators face twenty years in federal prison. This act can then legally be used against mosques and Islamic societies that commit treason or sedition. This act also requires all aliens in this country to register with the federal government. Those determined to be enemy aliens can then be detained or deported. The US Supreme Court upheld the Smith Act in Dennis v. the United States. In addition, the Voorhis Act of 1941 could be used. It requires all organizations that advocate the overthrow of the US Government to register with the government. This means that any Muslim group that calls for the establishment of Sharia Law on American citizens, can be subject to investigation and possible incarceration.

Another advantage to having a formal declaration of war, is we would be able to bring back into play the War Powers Act of 1941. Information about the war effort would be subject to government censorship. While the civil liberties gang would have their underwear in a knot over this one, Censorship has been the norm for every war from the Revolution through the Civil War, the Spanish American War, WW I, and WW II. It is a temporary measure that goes away after the enemy surrenders. It's very obvious that the media restrictions in place during WW II are no longer in place; just read the New York Times or the Washington Post. They weren't in place during Vietnam either. Pick up an old copy of Life Magazine. An important part of fighting a war is to present the appearance of a united front to the enemy. During WW II, the Office of Censorship censored over twenty stories per day, opened the mail of individuals deemed to be a danger to our national security, tapped phones, intercepted telegrams, banned the publication of several newspapers and prevented many radio broadcasts. These actions were all perfectly legal under the War Powers Act. They were also upheld by the US Supreme Court. In Ft. Minersville School District v. Gobitis, the Court ruled that during time of war, the right of the government to keep us safe, overrides freedom of religion, freedom of speech, and freedom of assembly. Writing for the majority, Justice Felix Frankfurter wrote: "To affirm that the freedom to follow conscience has itself no limits in the life of society would deny that very plurality which, as a matter of history, underlies protection of religious toleration. National unity is the basis of national security." Remember, both President Lincoln and President Wilson also issued executive orders implementing war time suspensions of Habeas Corpus during their administrations too.

A formal declaration of war, and it's ensuing powers granted to the government, would allow us to root out the spies and traitors working in our government agencies, colleges and universities, and media. Both the leakers in the government and Bill Keller, Editor of the New York Times, could be charged under the Espionage Act of 1917. If we had a formal declaration of war, Keller wouldn't have dared running the SWIFT story. If he did, the government could have moved in, shut down the New York Times, arrested Keller, and if he was convicted, sent him away for a long time to break rocks in a federal penitentiary. The person(s) who leaked the information to the Times, would have faced more serious charges. After all, this individual or these individuals possess top secret security clearances, and are privy to classified information that is never supposed to become public knowledge. Our ability to track the enemies financial transactions has been destroyed. The enemies working inside of the government would be charged with treason, and since it is a time of war, subject to capital punishment if convicted.

After 9/11 we became a united nation for a brief moment. Today, we are as divided as we were just prior to the Civil War. There is an enemy Fifth Column that is determined to bring down the US Government for their benefit. Over the past 100 years, they have managed to work their way into our government, education system, financial system, military, and judicial system. They will attempt to use the US Constitution as the tool to implode this country from within bringing about America's destruction while they hide behind its protections. The seeds of our destruction were planted in the early 1900s, and have been gaining strength ever since. Wake up and smell the coffee. We are at war with an enemy that hides in the shadows, doesn't wear a uniform, uses terrorism to advance it's goal of the destruction of the Western World. It has been working on this for fourteen hundred years. It is being aided by spineless liberals, who are more concerned about the rights of terrorists than about the rights of honest law abiding citizens. We can not let terrorists and their treasonous aiders and abetters hide behind the US Constitution at our own peril. We need to use whatever means we have at our disposal to bring to justice the people that saw off their prisoners heads with dull knives; capture two US soldiers and then drag them behind a truck on the street until all their skin is peeled off, castrate them, and then behead them and leave their booby trapped bodies by the side of the road. We can not allow these atrocities to continue, because there is a belief by the Left that WE are the enemy, not the enemy. If the enemy combatants held at GITMO are allowed to walk, what will prevent them from attacking us with chemical weapons or worse, because we didn't have the balls to call a spade a spade and "eliminate the problem."

The US Constitution is the best constitution in the world. Our Founding Fathers were geniuses when they wrote the Constitution and established a representative republic form of government, that has been the envy of the rest of the world. We can not allow our enemies to hide behind the Constitution and destroy us from both within and from outside. In 1944 Chief Justice Robert H.
